Seneca County Board of Health Files Appeal in ERAC

The Seneca County Board of Health has filed an appeal in Environmental Review Appeals Commission, asking the commission to vacate a recent Ohio EPA decision granting an expansion to WIN Waste Innovations of Seneca County.

The appeal was filed Friday, and seeks to vacate solid waste and air pollution permits that grant the landfill a 94acre expansion. The permits also allow WIN Waste Innovations of Seneca County to increase its daily waste intake from 7,500 tons to 9,500 tons, and to place its waste within 200 feet of surface waters, including streams and wetlands.

The appeal cites several allegations, including the allegations that the landfill already has one of the highest daily rates of waste receipts in the state, and that the facility has failed to demonstrate it will be able to operate an expanded landfill in compliance with environmental laws. The appeal outlines the landfill’s history of environmental law violations, with the most recent being the failure to implement inspection requirements and the falsification of inspection records.

“WIN Waste has already demonstrated that it can’t properly handle the size of its current landfill. We hope that the ERAC will seriously take into consideration the health of our residents and environment, and reverse Ohio EPA’s decision,” Seneca County Board of Health Member Bob Podach said.
